TINJAUAN YURIDIS HAK DAN KEWAJIBAN PARA PIHAK DALAM TRANSAKSI JUAL BELI ONLINE DI ERA DIGITAL (E-COMMERCE) Delfin Mahuri 170701050 Fakultas Hukum Universitas Muhammadiyah Riau ABSTRAK Penelitian ini dilatorbelakangi atas jual beli online melalui media elektronik atasu E-commercemenimbulkan perikatan antara pihak untuk memberikan suatu prestasi. Implikasi dari perikatan itu adalah timbulnya hak dan kewajiban yang harus dipenuhi oleh pihak yang terlibat. Seiring dengan perkembangan e-commerce, semakin bertambah juga permasalahan yang timbul akibat maraknya e-commerce tersebut. Untuk mengetahui keabsahan jual beli melalui media elektronik di era digital (E-commerce) dalam prespektif UU Nomor 11 Tahun 2008 tentang informasi dan Transaksi Elektroknik dan Untuk mengetahui proses penegakan hukum dan perlindungan hukum para pihak dalam transaksi jual beli online melalui media elektronik. Metode yang digunakan dalam penelitian ini adalah yuridis normatif dengan pendekatan kasus dan perundang-undangan. Hasil penelitan E-commerce ini, syarat tersebut tidak terpenuhi secara utuh,terutama dalam hal kecakapan, karena sulit mengetahui apakah para pihak dalam e-commerce tersebut (terutama customer) sudah berwenang untuk melakukan suatu perbuatan hukum (jual beli melalui internet) atau tidak, selama transaksi dalam e-commerce tidak merugikan bagi kedua belah pihak, maka transaksi tersebut dianggap sah. Penegakan dan perlindungan hukum para pihak dalam transaksi jual beli online melalui media elektronik meliputi penegakan hukum yang dilalukan menggunakan materil dari KUHP, UU ITE dan UUPK. Selanjutnya perlindungan hukum dibedakan menjadi perlindungan dalam perjanjian yaitu perlindungan hukum yang dibuat oleh merchant dalam bentuk aturan yang telah disepakati kedua belah pihak yang berasal dari UU ITE Pasal 25 yang mengatur tentang privacy berupa dat pribadi merchant dan customer. Perlindungan hukum diluar perjanjian yaitu perlindungan hukum terhadap Hak Atas Kekayaan Intelektual untuk nama domain yang memiliki oleh merchant sebagai pendaftar pertama, yang terdapat dalam Pasal 23 UU ITE. JURIDICAL REVIEW OF THE RIGHTS AND OBLIGATIONS OF PARTIES IN ONLINE BUYING AND SELLING TRANSACTIONS IN DIGITAL ERA (E-COMMERCE) Delfin Mahuri 170701050 Faculty of Law University of Muhammadiyah Riau ABSTRACT This research is motivated by online buying and selling through electronic media or e-commerce raises engagement between parties to provide an achievement. The implications of the engagement are the emergence of right and obligations that must be filfilled by the parties inloved. Along with the development of e-commerce, there are also increasing problems that arise due to the widespread of the e-commerce. One problem arises, namely the presence of default by one of the parties inloved in the e-commerce. To find out the validity of buying and selling trought electronic media in the digital era (e-commerce) in the perspective of law No. 11 of 2008 concerning Information and Electronik Transactions and to find out the process of enforcement and protection of the laws in online buying and selling transactions through electronic media. The method used in thid study is normative juridical with the case approach and legislation. The results of this e-commerce study, these conditions are not fully fulfilled, especially in terms of skills, because it is difficult to find out whether the parties in the e-commerce (especially customers) have been authorized to commit a legal act (buying and selling via the internet) or not, as long as the transaction in e-commerce does not harm the two sides, the transaction is considered legitimate. The law enforcement and protection of the parties in online buying and selling transactions through electronic media include law enforcement carried out using the material from the Criminal Code, Law ITE and UUPK Furthermore, legal protection is distinguished into protection in the agreement, namely legal protection made by the merchants and customers. Legal protection beyond the agreement is legal protection against the right to intellectual property for the domainname owned by merchant as the first registrant, whivg is found in Article 23 of the ITE Law.
